Abstract

The present thesis examines the designation of origin, a concept that has traditionally been studied by private law doctrine. The first part of this work addresses the study of three aspects: its background and origin, the current concept according to European regulations, which also includes the analysis of other figures closely related to designation of origin but with their own characteristics, and the registration process. The second part aims to present arguments supporting the juridical-administrative nature of designation of origin. With this objective, a justification is made for excluding this concept from the category of industrial property rights, despite its status as a distinctive sign. Additionally, emphasis is placed on the public interest underlying this concept. Finally, in the third and last part, this concept is analyzed within the Galician context, with special attention given to the distribution of competences between the State and the Galician Autonomous Community, the current legal framework, which is expected to be altered as a result of the Draft Law on Galician Food Quality, the consequences of Brexit, and its economic relevance in domestic and international markets.
