Abstract

The protection of pregnant workers against discrimination in the workplace, by recognizing their right to a reasonable job accommodation, gives in the United States clear examples of how the federal legislative branch reacts to unsatisfactory judicial decisions, although the reaction time is not always the same. Thus, the reaction embodied by the federal Pregnancy Discrimination Act of 1978 was almost immediate, after the judicial decision that triggered it. On the contrary, the reaction of the federal Pregnant Worker Fairness Act of 2022 proved to be a little slower.
