Abstract

This paper reviews the normative and jurisprudential treatmentof the procedural mechanism of legality control in the AndeanCommunity: the annulment action in the jurisdiction of theCourt of Justice of the Andean Community. The work asseshow the annulment action is regulated in the Tribunal CreationTreaty and its Statute and compares its juridical nature withother procedural mechanisms that the Andean court examines.That said, it compares the annulment action with other similarjuridical figures in Spanish and European law. Finally, thearticle compiles a diverse group of jurisprudentialdevelopments of the Andean Community Court of Justice to analyze more deeply how the annulment action functions inthe Andean community law.
