Abstract
Community courts of justice, such as the Court of Justice ofthe Andean Community or the Court of Justice of the EuropeanUnion, are assigned, among others, the essential function ofguaranteeing that community law rules are interpreted andapplied uniformly in the territory of the member States. Thisfunction is developed through the preliminary ruling,establishing a judicial dialogue between the national judge(judge a quo) who raises a doubt of interpretation or validity to the community judge (judge ad quem) on a communitynorm that he must apply. This judicial dialogue raises manyunknowns derived from the absence of a determined conceptof “national judge”. The purpose of this work focuses, inparticular, in seeing how arbitration has made its way withinthis judicial dialogue, emphasizing the configuration of thisinstitution by the Court of Justice of the Andean Community,anticipating lines of reflection for its future development.
