Resumen
The likelihood of confusion, defined as the risk that the public may believe that certain goods or services come from the same company or, as the case may be, from economically related companies, constitutes a central figure of trademark law, as it directly affects the scope of protection conferred by the exclusive right. The determination of the existence of likelihood of confusion must be based on a global assessment of all the factors relevant to the specific case, including the identity or similarity of the goods or services and the distinctive character of the earlier trademark. Such Assessment must be made from the perspective of the reference consumer of the goods or services: the average consumer.
