Las operaciones de liquidación concursal

Abstract

This paper examines the main news introduced by Law 16/2022 in the regulation of liquidation operations. The enhancement of efficiency in bankruptcy situations has meant the elimination of the liquidation plan and the streamlining of the procedures that must be observed for the development of liquidation operations of the active mass. In this new context, doubts and questions arise related to the making of the special rules, as a task incumbent to the bankruptcy judge, and with the entry into play of the supplementary rules, which are applied in default of those. Likewise, the traditional registry problems subsist, motivated by the registration of the dispositive acts carried out by the bankruptcy administration, and new ones arise, due to the absence of judicial authorization that covers these disposals of assets.
