Abstract

The United Nations Convention on the Rights of Persons with Disabilities (2006), rati-fied by Spain and the European Union, has enshrined the social model of disability. However, the implementation of the social model in the Spanish labor law and, in particular, in the regulation of the termination of the employment contract is, to date, still unsatisfactory. The study analyzes the three cases in which the legal regulation of the termination of the employment contract and its judicial application have come up against the enforceable effectiveness of the prohibition of discrimination due to disability. And, in particular, the impact that Law 15/2022, of July 12, com-prehensive for equal treatment and non-discrimination, has had on the resolution of all these problems.
