Abstract

This study focuses on the EUCJ case law about consumer’s protection by national courts. Specifically, it deals with the ex officio doctrine, which gives national judges an active role on consumer’s protection. The analysis is made in three steps: firstly, summarizing the EUCJ doctrine deriving Directive 93/13; secondly, studying the Bondora decision, on the applicability of the former general doctrine to the European Order of Payment proceedings; finally, an approaching is made to the applicability of this doctrine to the European Small Claims proceedings. The study is closed with a brief reflection on the principles of an special civil procedural law on consumer’s relationships.
