Abstract

The possibility of protecting the object of an expired patent through Copiright have been brought up at the Court of Justice due to the famous three positions of the Brompton bicycles. The ruling of the ECJ allows us to cover several key aspects of Industrial and Intellectual Property Rights, such as the technical functionality exclusion and the cumulation of rights. Following on from the Brompton case, this paper aims to examine how the Court of Justice has interpreted these issues in trade mark, desing and copyright law.
