Abstract
This paper discusses the use that workers do of ICTs in relation with their right to privacy as opposed to the employer’s right to supervision and surveillance within the occupational sphere. In particular, it deals with the impact that employer’s surveillance may have over the worker fundamental rights. Likewise, it examines the possible consequences that ICTs use may have both over the social order (dismissal) and the penal order. For that, we take into consideration the control and supervising abilities that the company can exert in order to verify that the workers perform their duties properly whenever they are using them at work or if there may be disloyalty and lack of performance otherwise.
